What happens if I till enrolled acres before the end of
the contract period?
In the event that the land fails to meet the above
requirements, all XSOs from such land shall be null and void
and any payments for XSOs delivered prior to January 1, 2013
shall be repaid. The aggregator is required
to place 20 percent of the offsets it earns into a soil
carbon reserve pool for such cases. Any remaining offsets
will be returned to project participants at the end of the
agreement period.
How often is the enrolled acreage verified?
The enrolled acreage is verified at the time of enrollment. In following
years, random acres are selected for an audit verification.
I plant tobacco on my land in different locations. As long as the
number of no-till acres stays the same, am I still eligible?
The same enrolled acres must be kept in no-till production the entire
contract period. Tilling any portion of the specified enrolled acres
will void any agreement and all XSOs from such land from the previous
years shall be repaid.
I lease my enrolled acres. What happens if the land is turned over
to another leaser during the contract period?
The person signing the contract with KyCGA/KySGGA is responsible for the
enrolled acres. Should you no longer have management control over the
enrolled acres, any non-eligible tilling methods that occur will void
any agreement and all XSOs from such land from the previous years shall
be repaid. If the new producer remains in compliance for the completion
of the program, the original contract owner will receive credit.
